Compliance with Privacy Regulatory Requirements in Europe

Foreign firms, that want to import personal data from UE, have to follow EU privacy regulatory requirements. Sector-specific legislation can develop, adapt and propose new and complementary elements, as well as further modifications in the legislation. In fact, recently:

  • The Court of Justice invalidates Decision 2016/1250 on the adequacy of the protection provided by the EU-US Data Protection Shield.
  • The Commission Decision 2010/87 stated that compliance with standard contractual clauses for the transfer of personal data to processors established in third countries is required.

If this is not ensured, the exporter is obliged by the competent supervisory authority to suspend the transfer of data.
